1. Introduction

This Acceptable Use Policy (“Policy”) sets out the content standards and rules of conduct that apply when you access or use the Momentum mobile application, the websites momentum-pt.app and momentum-pt.co.uk, and any associated services (collectively, the “Platform”). The Platform is operated by AMNOVA LIMITED (“Company”, “we”, “us”, or “our”), a company registered in England and Wales under company number 16394638, with its registered office at Unit A, 82 James Carter Rd, Mildenhall, Bury Saint Edmunds IP28 7DE.

By using the Platform, you confirm that you accept the terms of this Policy and that you agree to comply with them. This Policy forms part of our Terms of Service.

2. Prohibited Uses

You may use the Platform only for lawful purposes. You may not use the Platform:

  • In any way that breaches any applicable local, national, or international law or regulation.

  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.

  • For the purpose of harming or attempting to harm minors in any way.

  • To bully, insult, intimidate, or humiliate any person.

  • To send, knowingly receive, upload, download, use, or re-use any material which does not comply with our Content Standards (see Section 3 below).

  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programmes or similar computer code designed to adversely affect the operation of any computer software or hardware.

Specific Platform Prohibitions: In addition to the above, Personal Trainers (“PTs”) and clients are strictly prohibited from using the Platform to:

  • Promote, sell, or distribute performance-enhancing drugs (PEDs), anabolic steroids, or illegal substances.

  • Promote, sell, or distribute unregulated dietary supplements.

  • Make unsubstantiated, dangerous, or “guaranteed” medical, health, or weight-loss claims.

3. Content Standards

These content standards apply to any and all material which you contribute to our Platform, including exercise videos, workout plans, text descriptions, and communications (“User Content”).

User Content must:

  • Be accurate (where it states facts).

  • Be genuinely held (where it states opinions).

  • Comply with the law applicable in England and Wales and in any country from which it is posted.

User Content must not:

  • Be defamatory of any person.

  • Be obscene, offensive, hateful, or inflammatory.

  • Promote violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

  • Infringe any copyright, database right, or trademark of any other person.

  • Be likely to deceive any person.

  • Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.

  • Promote any illegal activity or advocate, promote, or assist any unlawful act.

  • Impersonate any person or misrepresent your identity or affiliation with any person.

4. Interactive Services and Communications

The Platform may provide interactive services, including in-app messaging or communication channels between PTs and clients.

AMNOVA LIMITED operates these channels on a strictly reactive, “report-and-review” basis. We do not proactively monitor, oversee, or moderate the private communications or content shared between users within the Platform. We expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards.

5. Responsibility for End Users

If you are a PT using the Platform to deliver services to your clients, you are strictly responsible for ensuring that your clients are aware of and adhere to this Policy. You will be held accountable for any violations committed by your clients within the Platform.

6. Suspension and Termination

We will determine, at our absolute discretion, whether there has been a breach of this Policy through your use of the Platform. When a breach of this Policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this Policy constitutes a material breach of the Terms of Service upon which you are permitted to use the Platform, and may result in our taking all or any of the following actions:

  • Immediate, temporary, or permanent withdrawal of your right to use the Platform.

  • Immediate, temporary, or permanent removal of any User Content uploaded by you to the Platform.

  • Issue of a warning to you.

  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

  • Further legal action against you.

  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

We exclude our liability for all action we may take in response to breaches of this Policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

7. Reporting Violations

If you become aware of any violation of this Policy, or if you believe another user is behaving inappropriately or uploading restricted content, you must report this immediately. Please forward all reports, including relevant screenshots or evidence, to: support@momentum-pt.app.

8. Changes to the Acceptable Use Policy

We may revise this Policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you.

  • Financial Cap: To the maximum extent permitted by law, AMNOVA LIMITED’s total liability to you for any claims arising from or related to the Platform shall not exceed the total amount you paid to us in the three (3) months preceding the event giving rise to the claim.

  • Exclusion of Damages: We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Platform.

  • Indemnity: You agree to indemnify, defend, and hold harmless AMNOVA LIMITED from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or, if you are a PT, any claim brought by your client regarding the fitness services you provided through the Platform.
