1. Introduction
This Medical and Health Disclaimer (“Disclaimer”) forms an essential part of the Terms of Service for the Momentum mobile application, the websites momentum-pt.app and momentum-pt.co.uk, and all associated services (collectively, the “Platform”). The Platform is owned and operated by AMNOVA LIMITED (“Company”, “we”, “us”, or “our”), a company registered in England and Wales under company number 16394638, with its registered office at Unit A, 82 James Carter Rd, Mildenhall, Bury Saint Edmunds IP28 7DE.
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Disclaimer.
2. No Medical Advice
The Platform is designed strictly for fitness tracking, workout management, and educational purposes. AMNOVA LIMITED is a technology provider, not a healthcare provider.
Nothing contained within the Platform, whether provided by us, generic exercise libraries, or independent Personal Trainers (“PTs”), constitutes medical advice, diagnosis, or treatment.
Your use of the Platform does not establish a doctor-patient relationship.
You should never disregard professional medical advice or delay seeking it because of something you have read, viewed, or been instructed to do on the Platform.
3. Assumption of Risk
Engaging in any exercise, fitness programme, or nutritional plan carries inherent risks of physical injury, illness, or in extreme cases, death.
You expressly agree that your participation in any activities guided by the Platform is undertaken entirely at your own risk.
You must consult with a qualified medical professional before beginning any new fitness regime, especially if you have a pre-existing medical condition, are taking medication, or have not exercised recently.
If you experience faintness, dizziness, pain, or shortness of breath at any time while exercising, you must stop immediately and seek medical attention.
4. Nutritional and Dietary Information
The Platform allows PTs to distribute nutritional guidance, macronutrient targets, and meal plans.
AMNOVA LIMITED does not vet, audit, or verify the qualifications of PTs using the Platform. We make no representations that any PT is a registered dietitian or licensed nutritionist.
Any dietary information provided through the Platform is for general informational purposes only and must not be construed as medical nutritional therapy.
We bear no responsibility for adverse reactions, allergies, or health complications resulting from dietary advice received through the Platform.
5. Specialised and High-Risk Training
PTs may use the Platform to provide programming for specialised or vulnerable populations, including but not limited to prenatal clients, postnatal clients, and individuals undergoing active injury rehabilitation.
If you belong to a specialised population, it is strictly your responsibility to obtain explicit medical clearance from your physician or obstetrician before following any routine on the Platform.
AMNOVA LIMITED accepts zero liability for any injury, complication, or exacerbation of a condition resulting from following specialised programming hosted on our infrastructure.
6. Wearable Technology and Third-Party Data
The Platform may integrate with or pull physiological data from third-party wearable technology and health applications (including, but not limited to, Apple Health, Google Fit, and Garmin).
AMNOVA LIMITED makes no warranties regarding the accuracy, reliability, or medical validity of any data, heart rate metrics, or caloric calculations sourced from these third-party devices.
You must not rely on wearable data displayed within the Platform for making medical, dosing, or critical health decisions.
7. Total Liability Waiver and Indemnity
To the maximum extent permitted by applicable law, you irrevocably release, waive, and discharge AMNOVA LIMITED, its directors, employees, contractors, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any physical injury, illness, death, or property damage sustained while using the Platform or following any instruction, video, or plan contained therein.
You agree to indemnify and hold harmless AMNOVA LIMITED against any claims brought by third parties (including, if you are a PT, your clients) arising from physical or medical harm related to the use of the Platform.
All code, design, branding, standard text, and generic video content provided by Momentum remains the exclusive property of AMNOVA LIMITED. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose. You may not reverse-engineer, copy, or distribute any part of the Platform without express written consent.
